These Terms & Conditions (“Terms”) govern your access to and use of SeptoberFest’s websites and mobile applications (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance #

If you do not agree to these Terms, do not use the Service. You may use the Service only in compliance with these Terms and all applicable laws.

2. Eligibility #

You must be able to form a binding contract under applicable law. Some features may have additional age or regional restrictions.

3. Accounts & Registration #

You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. App Features (Program, Vendors, Maps, Polls) #

  • Program & Events: Schedules may change; times and line-ups are provided “as-is”.
  • Vendors: Listings and images are provided by vendors and/or event organizers.
  • Maps & Location: Map accuracy and availability may vary. Location features require device permissions.
  • Polls: Polls are for engagement/feedback and are not official votes or contests unless explicitly stated.

5. User-Generated Content #

If you submit content (e.g., images, text, feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with the Service. You represent that you own or have the necessary rights to the content you submit.

6. Prohibited Uses #

  • Violating any law or the rights of others.
  • Uploading harmful code or interfering with the Service.
  • Scraping or bulk-downloading content without permission.
  • Impersonating another person or misrepresenting your affiliation.

7. Intellectual Property #

The Service, including text, graphics, logos, and software, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not use our trademarks without prior written consent.

The Service may link to third-party websites or services. We do not endorse or assume responsibility for their content or practices. Your use of third-party services is at your own risk.

9. Tickets, Purchases & Payments #

If purchases are offered, they may be processed by third-party payment providers. Prices, taxes, and fees are shown at checkout. Please review any additional terms presented during purchase. Unless required by law, all sales are final unless a refund policy is explicitly stated.

10. Disclaimers #

THE SERVICE IS PROVIDED “AS-IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability #

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification #

You agree to defend, indemnify, and hold harmless SeptoberFest and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

13. Termination #

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.

14. Governing Law #

These Terms are governed by the laws of the Republic of Zambia, without regard to conflict-of-law principles. Venue for any dispute lies in competent courts in Zambia.

15. Changes to Terms #

We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
